position of the Executive Board

PUBLIC NOTICE
The Oglala Sioux Tribe
Transportation Department along
with Dakota Engineering will be performing
reconstruction work on the
following Indian Reservation Road
(IRR) project.
BIA Route 14 - Gooseneck Road -
Project No. 14-08-17
•The primary purpose of this project
is to improve safety and efficiency
of the travelling public. The proposed
project includes restoring the
existing road surface to the required
design width and then adding
Aggregate Base Course (gravel).
This work will be completed by the
OST Transportation Construction
Force Account employees. That
work will then be followed by 4" of
Hot Asphalt Concrete pavement plus
center line and shoulder paint striping.

•The work is scheduled to begin
within 2 weeks with gravel being
hauled over BIA Route 27 to the project.
The asphalt will be completed
during the summer after the work is
advertised for bids and a contractor
is selected to perform that work. All
work is scheduled for completion by
Fall of 2009. Damage to the existing
asphalt surface from hauling gravel
and asphalt over Route 27 will be
repaired upon completion of the
paving of this project.
•The road will remain open with
some traffic delays. To facilitate the
timely completion of work, we ask
that the travelling public use alternate
routes when possible.

requesting bids to repair a 102' 5" X
58' 9" hardwood gym floor.
Approximate area to repair is ¼ of
total area or 2,300 sq ft.
Proposals are sealed bid, therefore
faxes and e-mails will not be
accepted. They must be marked,
"SGU Hard Wood Floor Repair". The
deadline is March 20, 2009 by 5:00
p.m.

ROSEBUD SIOUX TRIBE
UTILITY COMMISSION
WILL HOLD A PUBLIC
HEARING ON CHERRY TODD
ELECTRIC COOPERATIVE
RATE INCREASE
March 6, 2009 at the Tribal
Council Chambers Building
ROSEBUD - Pursuant to the
Rosebud Sioux Law and Order
Code, Title 20: Utilities, the Rosebud
Sioux Tribal Utility Commission has
been established and is duly authorized
to supervise and regulate the
operation of all telecommunications,
utilities, and cooperatives located or
operating within the Rosebud Sioux
Reservation, including Todd,
Mellette, Tripp, Gregory and Lyman
counties.
The Cherry Todd Electric
Cooperative is a electric service

provider, operating and providing
electrical services engaged in the
generation and distribution of light,
heat or power, within the boundaries
of the Rosebud Reservation and
therefore meets the definition of
"Utility" under RST Law and Order
Code Title 20 Chapter 2, Section 20-
2-101(9).
20-4-101(4) Power of Commission
to Establish Rates. The Commission
shall supervise all rates, tariffs, and
charges of all utilities located or operating
within the Reservation. It shall
have the power, after notice and
hearing, to originate, establish, modify,
adjust, promulgate, and enforce
all rates, tariffs, and charges of all
utilities. Whenever the Commission,
after hearing, shall find any existing
rates, tariffs, charges, or schedules
unjust, unreasonable, insufficient,
unjustly discriminatory, or otherwise
in violation of any of the provisions of
this Title, the Commission by order
shall fix reasonable rates, joint rates,
wheeling rates, charges, or schedules
to be followed in the future in
lieu of those found to be unjust,
unreasonable, insufficient, unjustly
discriminatory, or otherwise in violation
of any provision of law.
20-4-101(2)(e) Hold hearings on
good cause shown or on its motion,
and to provide notice thereof prior to
hearing. Such notice shall be reasonable
in view of the nature, scope,
and importance of the hearing.
Whenever it shall appear to the satisfaction
of the Commission that all of
the interested parties have agreed
concerning the matter at hand, the
Commission may issue its order
without a hearing.
The Commission on February 17,
2009 passed a motion to file a complaint
regarding the electrical rate
increase of 22% on Cherry Todd
Electric Cooperative for not complying
with RST Law and Order Code
Title 20 Utilities with regards to the
electrical rate increase. And that a
public hearing on Cherry Todd
Electric Cooperative electrical rate
increase of 22% is set for Friday,
March 6, 2009 starting at 10:00 am to
2:00 pm at the Tribal Council
Chambers in Rosebud.
The purpose of the Cherry Todd
Electric Cooperative Rate Hearing to
permit the utility service provider and

members of the public the opportunity
to comment on /or change in regulatory
authority, and also to comment
on any proposed exercise of TUC's
regulatory authority.
This public notice is being given to
the Cherry Todd Electric Cooperative
are hereby notified that a Rate
Increase Hearing has been set
before the Rosebud Sioux Tribe
Utilities Commission 6th day of

March, 2009, starting at 10:00
o'clock a.m., at the Rosebud Sioux
Tribal Council Chambers building,
Rosebud, South Dakota.
