TO WHOM IT MAY CONCERN: The Shannon County School District, herein called the Owner, of the City of Batesland, Shannon County, State of South Dakota, will receive sealed bids for the replacement of the bleachers and a new wood floor at the Wolf Creek School, until 5:00 P.M., Local Time on the 2 day of July, 2009, at the Shannon County School District Offices, P. O. Box 109, Batesland, South Dakota 57716-0109, at which time and place all bids will be publicly opened and read. The Contract scope consists of: the removal and replacement of the wood bleachers and a new wood floor in the gymnasium at the Wolf Creek School.

A Single Contract will be awarded for All Work. All bids shall be made in accordance with forms referenced to and/or made a part of the proposed contract documents. Bids shall be submitted in a sealed envelope addressed to Shannon County School District, P.O. Box 109, Batesland South Dakota 57716-0109. Bid envelopes shall be clearly marked on the outside lower left corner Bleacher Replacement and Wood Floor Project. Full responsibility for the delivery of mailed bids prior to the deadline for receiving bids rests with the bidder. Contract documents, including bid proposal forms, drawings and Project Manual, have been placed on file and may be examined and obtained at the officeof Henriksen, Inc.; 526 Saint Joseph Street, Suite A; Rapid City, SD 57701.

Each General Contract Bidder and each subcontract Bidder as well as material suppliers will be issued one complete set of documents for preparing his bid for a DEPOSIT of $50.00 which will be refunded upon returning such set in good unmarked condition within 14 days after the bid opening. Make all checks payable to Henriksen, Inc. and mark them "Bleacher Replacement and Wood Floor Project".

Each bidder must deposit bid security with the bid, payable to Shannon County School District and shall be one of the following: 1. Certified check, cashier's check or draft drawn on a State or National Bank in the amount of five percent (5%) of the bidders base bid including alternates (if any). 2. Bid Bond, prepared on AIA Form A310, issued by a Surety authorized to do business in the State where the project is located and acceptable to the Owner in the amount of ten percent (10%) of the bidders base bid including alternates (if any).

The successful bidder shall be required to furnish a contract performance bond and a labor and materials payment bond in the penal amount of one hundred percent (100%) of the contract price as originally bid or subsequently modified.

No bidder may withdraw a bid until 30 days after the bid opening, without a written request explaining the cause for the withdrawal and without a written consent of the Owner after reviewing the cause.

The Owner reserves the right to reject any and all bids or parts thereof, and to waive any irregularities of any bid. The Owner also reserves the right to award the contract to the lowest responsible bidder as may be determined by the Owner.

The Contract scope consists of: A Single Contract will be awarded for General Construction Work. Indian preference will be enforced according to Oglala Sioux Tribe Procurement Requirements and TERO Regulations. All bids shall be made in accordance with forms referenced to and/or made a part of the proposed contract documents. Bids shall be submitted in a sealed envelope addressed to Shannon County School District. Bid envelopes shall be clearly marked on the outside lower left corner correponding Wolf Creek School Sidewalk and Drainage Improvement Project. Full responsibility for the delivery of mailed bids prior to the deadline for receiving bids rests with the bidder. Although not a requirement, it is advisable that the contractor inspects the project site to familiar himself with the site and cooresponding site preparations requirements prior to the bid opening. Each Prime Contractor will be issued one complete set of documents for preparing his bid for a REFUNDABLE DEPOSIT of $60.00 for corresponding Wolf Creek School Sidewalk and Drainage Improvement Project shipping costs $10.00 (ground) or $25.00 (next day air). The plan deposit will be refunded upon returning such set in good unmarked condition within 14 days after the bid opening. Additional sets of documents for prime contractors and all sets for subcontractors and material suppliers may be purchased by non-refundable costs of reproduction from the A/E. BIA ROUTE 27 - SECTION 10

OGLALA SIOUX TRIBE PINE RIDGE, SOUTH DAKOTA

NOTICE IS HEREBY GIVEN, that the Oglala Sioux Tribe of Pine Ridge, South Dakota, will receive, bids until July 6, 2009 at the hour of 4:00 PM (MT) at the officeof Dakota Engineering - a Kadrmas, Lee & Jackson Partner, 330 Knollwood Drive, Rapid City, South Dakota 57701. The bid documents shall be sealed and en-dorsed, "BIA Route 27 - Overlay". This is for the furnishing of materials, labor, equipment and skill re-quired for the purpose of Hot Asphalt Pavement Overlay, as is more fully described and set forth in the Plans and Project Manual, which are now on file in the officeof the Oglala Sioux Tribe, Pine Ridge, South Dakota and at the officeof Dakota Engineering. Bids shall be publicly opened and read on July 7, 2009 at the hour of 10:00 AM (MT) at the Oglala Sioux Tribe Property and Supply Office in Pine Ridge.

The project generally consists of, but is not necessarily limited to, the following major items:

BIA Route 27 - Section 10 which is from US18 North for 4.78 miles - The existing asphalt surfaced road shall be cold milled to an average of 1 inch depth. The road shall then be spot patched and a 2 inch Hot Asphalt Concrete Pavement overlay placed. Work shall also include completing the white and yellow pavement marking paint.

The Contract Documents consisting of half size Drawings and Project Manual may be examined or obtained from Dakota Engineering, 330 Knollwood Drive, PO Box 3416, Rapid City, South Dakota 57701. Required deposit is $50.00 per set, which is not refundable, by regular mail or United Parcel Service (UPS). The Bidder is advised that the Owner is a federally recognized Indian Tribe and is completing an asphalt over-lay of the BIA 27 - Section 10 Project as part of its Indian Reservation Roads (IRR) Program with funds re-ceived under its Federal IRR Program Agreement as set forth more fully in the Bid Form and the Supplemen-tary Conditions.

The BIA Route 27 - Section 10 Overlay Project shall be conducted in accordance with all applicable Laws and Regulations and the terms of the Owner's Federal IRR Program Agreement including the requirement that the project be listed on the IRR Transportation Improvement Program (TIP) approved by the Federal Highway Administration.

The Contractor shall comply with all applicable Federal civil rights laws and regulations. The Contractor shall, in all solicitation or advertisements for employees placed by or on behalf of the Contractor, state that all applicants will receive consideration for employment without regard to sex, race, creed, color, or national origin, and that a preference shall be applied for qualified Indian applicants.

This contract includes a Native American Preference. If a Native American Contractor's bid is less than five percent higher than a non-native American Contractor's bid, the contract may be awarded to the Native American Contractor. Firms or individuals seeking such preference must submit evidence of Indian ownership and control in the sealed bid envelope.

The successful Bidder and subcontractors in performance of the construction work will be required to comply with all applicable federal labor laws including minimum wage rates decisions of the United States Department of Labor (Davis-Bacon Act) and the Oglala Sioux Tribe. The Contractor shall be required to comply with the terms and conditions of the Oglala Sioux Tribe, including Ordinance No. 92-13 of the Tribal Employment Rights Office (TERO), as contained in the Project Manual. The TERO Information sheets and Compliance Plan are included in the Project Manual only for the Vendor's convenience, with all TERO documentation to be submitted to the proper TERO authorities listed in the documents. The Contractor must submit a letter stating proof of compliance to the Owner, copied to the Engineer, prior to commencing work. The Tribal Employment Rights Office can be contacted for ques-tions at (605) 867-5167.

The successful Bidder will not be required to pay the 4% TERO fee, as that will be paid by the Oglala Sioux Tribe Department of Transportation based on the total bid amount.

Bidders are responsible for contacting the Tribe with regard to Tribal tax laws and the business license fee and other requirements. The taxes include contractor's excise, sales and use taxes, additional infor-mation is included in the specifications. The contract work shall be completed within 20 Working Days. Upon award of the contract a Notice to Pro-ceed will be issued stating when construction operations are to begin. The stated date for beginning of con-struction operations will be the beginning of the working day count.

All bids are to be submitted on the basis of cash payment for the work and materials, and each bid shall be accompanied by a certified check or cashier's check or draft for five percent (5%) of the amount of the bid, such check to be certified or issued by either a state or national bank and payable to the Oglala Sioux Tribe or in lieu thereof, a bidder's bond in a sum equal to ten percent (10%) of the full amount of the bid. Successful Bidder shall furnish an approved Construction Performance Bond and Construction (Labor and Materials) Payment Bond, each in the amount of one hundred percent (100%) of the contract amount. Insurance as required shall be provided by the successful Bidder and a certificate of that insurance shall be provided in accordance with Article 5 of the General Conditions as amended.

No bid may be withdrawn after the scheduled time for the public opening of the Bids specified above.

The Oglala Sioux Tribe reserves the right to reject any and all bids, to waive any informality in any bid, to hold all bids for a period not to exceed sixty (60) days from the date of opening bids, and to accept the bid deemed most favorable to the interest of the Tribe.

Should the Contractor fail to complete the work within the time required herein or within such extra time as may have been granted by formal extensions of time approved by the Owner, there will be deducted from any amount due the Contractor the sum of $500 per day for each day and every day that the completion of the work is delayed. The Contractor and his surety will be liable for any excess. Such payment will be as liquidated damages and not as a penalty.

All bidders are invited to be present at the public opening of the bids.
